Court sets aside Judgement on Section 84(12) of Electoral Act

The Court of Appeal sitting in Abuja has set aside the judgment of a Federal High Court in Umuahia which voided the provision of Section 84(12) of the Electoral Act 2022.

Delivering Judgement, the Presiding Judge, Hamma Barka held that the Federal High Court had no jurisdiction to have entertained the case because the plaintiff, Nduka Edede, lacked the right to have filed the suit.

Justice Barka added that Edede did not establish any cause of action to have warranted his approach to the court.

Recalled, Section 84(12) of the Electoral Act provides that, No Political Appointee shall be a voting delegate or be voted for at the convention or congress of any Political Party
