The Appeal Court sitting in Enugu state has dismissed the suit filed against Ebonyi State Governor, David Umahi and his Deputy, Kelechi Igwe over their defection from Peoples Democratic Party, PDP, to the All Progressive Congress, APC.

In a unanimous judgment delivered by A. Belgore, the court held that Governor Umahi and his deputy had the right to move to any political party they so wished.

Justice Belgore added that the constitution does not barr a sitting governor from defecting to any political party.

Recall that the Ebonyi State High Court struck out the same suit and awarded N500, 000 as damages against the plaintiff.
